(Tuesday, August 28, 2018) – Issues with condominium associations are among the most vexing concerns of our City’s residents. That’s why I’ve been working hard to ensure that our residents know their rights under Florida’s Condominium Act.
The state’s Division of Condominiums recently proposed new rules that would provide enhanced enforcement and civil penalties for non-compliance with the Condominium Act. The Division is hearing public comments about the new rules, which are needed after recent changes were made to the state law.
Our City’s condo associations will soon be subject to fines and penalties for additional violations. The list of “minor offenses” under the proposed new rules has diminished. But the list of “major offenses” has expanded. These include improper board elections, failure to provide official records, conflict of interest disclosures, and violations of fiduciary duty.
Equally important, the proposed rules reflect a major policy shift from education and rehabilitation, to enforcement. These enhanced compliance measures are welcome news for our residents.
As a City Commissioner, I have met so many residents and have always done my best to assist all individuals – even those outside of our City – with their problems.
I am now escalating my commitment to help our residents by hosting periodic “Condo Clinics” at City Hall. These meetings will allow me to help more of our residents. I am here to ensure that our city becomes a valuable resource, and even an advocate, to protect your rights.
